This Client Agreement outlines the terms and conditions governing your use of CREARE as a client seeking design, build, furnishing, renovation, or property‑related services through our platform. By accessing or using CREARE, you agree to comply with and be bound by the terms below.
1. Purpose of CREARE
CREARE is a marketplace platform that connects clients with qualified creators, designers, contractors, and property professionals. CREARE acts as an intermediary by facilitating communication, project management, and payment processing, but does not directly provide any construction or design services.
2. Eligibility
By using the platform as a client, you confirm that:
You are at least 18 years old.
You have the legal authority to enter into binding contracts.
You will provide accurate and up‑to‑date information.
3. Client Responsibilities
As a client, you agree to:
Provide clear, complete project details when submitting a request.
Communicate respectfully and professionally with creators.
Make timely payments for services rendered.
Ensure access to any property or site required for the project.
Comply with all local laws and regulations relating to your project.
4. Project Scopes & Proposals
Creators may submit project proposals including pricing, timelines, deliverables, and terms. As a client:
You must review and approve proposals before work begins.
Any changes to scope after approval may result in revised timelines or pricing.
CREARE is not responsible for misunderstandings caused by unclear project descriptions.
5. Payments
Payments on CREARE are processed securely through our integrated payment system.
You agree that:
Payments may be held in escrow until agreed project milestones are completed.
CREARE may charge platform fees, which will be disclosed before checkout.
Chargebacks or payment disputes may lead to account suspension pending resolution.
6. Cancellations & Refunds
Cancellations and refunds follow CREARE’s Refund Policy.
Refunds may be limited when:
Work has already commenced.
A creator has purchased materials.
Milestones have been completed.
CREARE reserves the right to review all refund requests.
7. Quality of Work
While CREARE screens creators, we do not guarantee:
The quality or suitability of a creator’s work.
That a project will meet your expectations if instructions were unclear.
Exact adherence to timelines affected by external factors.
Clients are encouraged to:
Check creator profiles, reviews, and portfolios.
Communicate expectations clearly.
Request revisions where applicable.
8. Dispute Resolution
If any dispute arises between a client and a creator:
You must first attempt to resolve it directly through the platform’s messaging system.
If resolution fails, CREARE may step in as a neutral mediator.
CREARE’s decision regarding mediation is final.
CREARE is not legally liable for disputes between users.
9. Property Access & Safety
For projects requiring physical access:
You must provide safe and lawful access to the site.
You are responsible for securing any required permits.
CREARE is not liable for issues arising from unsafe or inaccessible worksites.
10. Use of the Platform
Clients agree NOT to:
Circumvent the platform by hiring creators off‑platform.
Share false, misleading, or illegal project information.
Upload harmful files or violate the community guidelines.
Engage in harassment, discrimination, or abusive conduct.
Violation of these terms may result in account suspension or termination.
11. Property‑Related Services
If you use CREARE for property viewing, selling, buying, or renting:
CREARE does not guarantee the accuracy of property listings.
You must perform your own due diligence before making financial decisions.
CREARE is not responsible for misrepresentations made by property listers.
12. Limitation of Liability
CREARE is not liable for:
Losses caused by creators, contractors, or third‑party service providers.
Delays due to external factors (weather, permitting, supply issues, etc.).
Any damages resulting from misuse of the platform.
To the fullest extent permitted by law, your sole remedy is to stop using the platform.
13. Modifications to Terms
CREARE may update this Client Agreement from time to time. Continued platform use after changes means you accept the updated terms.
