These Property Listing Terms (“Terms”) govern the use of CREARE’s property-related services, including listing, promoting, buying, selling, or renting any form of property through the CREARE platform (“Platform”). By submitting, managing, or interacting with property listings, you agree to these Terms in full.

These Terms apply to:

  • Property Sellers (individual, agent, or company)

  • Property Buyers

  • Landlords, Developers & Property Managers

  • Anyone browsing or engaging with property listings on CREARE

1. Eligibility to List or Sell Property

To list a property on CREARE, you confirm that:
1.1 You have legal rights to sell, lease, or represent the property.
1.2 All information you provide is accurate, up-to-date, and not misleading.
1.3 You comply with all applicable real estate laws, regulations, and licensing requirements in your region.
1.4 You agree not to list properties on behalf of others without written authorization.

2. Accuracy of Listing Information

By posting a listing, you agree to:
2.1 Provide true and complete details about the property.
2.2 Upload images, videos, or documents that accurately represent the space.
2.3 Update the listing immediately if details change (e.g., price, availability, ownership).
2.4 Remove the listing promptly once the property is sold, rented, or no longer available.

CREARE may remove or suspend listings that appear inaccurate, misleading, duplicated, or fraudulent.

3. Prohibited Listings

You may NOT list:

  • Properties you do not legally control or own

  • Properties under legal dispute

  • Properties with unsafe conditions that violate local building codes

  • Fake, “bait-and-switch,” or deceptive listings

  • Land or property involved in legal restrictions without disclosure

CREARE reserves the right to decline or delete any listing that violates these standards.

4. Listing Fees & Payments

4.1 CREARE may charge listing fees, promotional fees, or transaction-related fees depending on the property category.
4.2 Fees are communicated transparently before publishing or boosting a listing.
4.3 Fees are non-refundable unless stated in the Refund Policy.
4.4 CREARE does not guarantee leads, viewings, or successful sales.

5. Role of CREARE

CREARE is a platform — not a real estate agency.
We do NOT:

  • Facilitate legal transfer of land or property

  • Handle escrow, deposits, or title verification

  • Provide legal, financial, or valuation advice

  • Represent either buyer or seller in negotiations

CREARE provides visibility, connection, and communication tools. Users handle all legal and transactional steps independently or through a licensed practitioner.

6. User Responsibilities

Sellers/Agents Must:

  • Ensure transparency in pricing

  • Respond to inquiries in a timely manner

  • Disclose any defects, restrictions, or liabilities

  • Ensure property access for verified viewings (if applicable)

Buyers Must:

  • Conduct independent due diligence

  • Verify ownership and title legitimacy

  • Arrange legal processes outside CREARE

  • Avoid fraudulent or manipulative inquiries

7. Property Media & Intellectual Property

7.1 By uploading photos, videos, floor plans, and documents, you grant CREARE the right to display, use, distribute, or promote them on the platform.
7.2 You must own all rights to the media you upload.
7.3 Any unlawful or stolen media will result in listing removal.

8. Communications & Negotiations

All communication between buyers and sellers through CREARE must remain:

  • Respectful

  • Transparent

  • Non-fraudulent

  • Within legal boundaries

CREARE may monitor conversations for safety and compliance.

9. Fraud Prevention & Verification

CREARE may require:

  • ID verification

  • Ownership verification

  • Additional documents

  • Property inspection reports (optional but recommended)

We may suspend or remove listings that cannot be verified.

10. Liability & Disclaimers

10.1 CREARE is not liable for:

  • Misrepresented listings

  • Failed transactions

  • False documentation provided by users

  • Property defects or disputes

  • Financial losses resulting from property deals

10.2 All property engagements are done at your own discretion and risk.

11. Removal, Suspension & Termination

CREARE may remove or suspend listings if they:

  • Violate legal standards

  • Receive repeated complaints

  • Pose safety concerns

  • Are discovered to be fraudulent or misleading

Persistent violations may result in account suspension.

12. Modifications to Terms

CREARE may revise these Terms to reflect legal updates, platform improvements, or new features. Updates will be posted with a revised date.
